Philadelphia’s Fair Workweek law guarantees reliable scheduling and compensation for over 130,000 Philadelphia restaurant, retail, and hospitality workers. Since going into effect in 2020, workers have been paid tens of thousands of dollars when their employers violated these rights — but too many workers still do not know about these protections and are losing out on money and the proper working conditions they rightfully deserve.

Philadelphia Fair Work Week law requires employers:

  • Post and provide 14-day advance notice of work schedules
  • Offer existing employees the right to additional work shifts before hiring new employees
  • Provide predictability pay for all employer-initiated changes to the posted schedule
  • Allow employees to refuse to work additional hours not included in the posted schedule

If you believe your rights have been violated at work and want to discuss the issue with an attorney, you can call or email Community Legal Services here. You can also file a complaint directly with the Philadelphia Department of Labor at fairworkweek@phila.gov or 215-686-0802.
